These Payment Terms apply to all financial transactions conducted through jbclawoffice.com, jbclaw.us, nyvisalawyer.com, longislandimmigration.com, nyimmigrationadvocates.com, or our associated payment portals. By remitting payment through this website, any of the previously listed sites, or any of our payment portals, you agree to the following terms and conditions:
1. Consultations and Cancellations
- Refund Policy: Payments made for legal consultations are fully refundable if the cancellation is requested at least 24 hours prior to the scheduled appointment time.
- Late Cancellations: If a consultation is cancelled within the 24-hour window, a refund is issued solely at the discretion of the Law Office of Joseph B. Caraccio. If we are unable to issue a refund, we will work with you to reschedule the consultation for a later date.
- Firm Cancellations: In the event that our office must cancel a consultation, you will receive a full refund of the fee paid.
- Limitation of Liability: A user’s damages for the cancellation of a consultation are strictly limited to the consultation fee paid.
2. Nature of the Consultation
A consultation fee entitles the user to a professional evaluation of their legal matter. It does not entitle the user to a set period of clock-time. A consultation may last fifteen minutes or sixty minutes; the attorney will use their professional judgment to determine when they have obtained the necessary information to provide a competent answer or review the matter thoroughly. Payment of a consultation fee does not entitle the user to ongoing services or additional legal work.
3. No Attorney-Client Relationship
Remitting a payment through this website does not unilaterally create an attorney-client relationship where one did not already exist, nor does it commit our office to represent you. We reserve the right to decline representation for any reason. If representation is declined, any funds paid prior to the execution of a formal, written retainer agreement will be refunded.
4. Dispute Resolution and Chargebacks
We are committed to resolving payment errors quickly and fairly. By using our online payment portal, you agree to the following:
- No Chargebacks: You agree that you will not request a “charge-back” from your bank or report a charge as unauthorized, even if you believe the amount is incorrect or was made in error.
- Mandatory Contact: You agree to first contact our office directly to resolve any error or dispute before taking any action with your financial institution.
- Dispute Process: If you wish to dispute a charge or invoice, you agree to (a) pay any undisputed portion by the payment due date, and (b) provide our office with a written explanation of the dispute and supporting documentation by that same date. We will work together to resolve the matter promptly; any newly agreed-upon amount must be paid within 10 days of resolution.
5. Refund Processing
Any refunds authorized by our office may take 7 to 10 business days to appear in your account, depending on your financial institution’s processing times.
6. Classification of Funds
Users understand and agree that payments made through this website are payments for legal services rendered (such as fixed-fee consultations or flat-fee milestones). These funds are not retainers and are not held in an escrow or IOLA account; they are considered earned upon receipt or according to the terms of your specific service agreement.
7. Payment Methods and Security
- Data Privacy: We do not store your payment information. Your data is used only once for a single, secure transaction.
- No Automatic Payments: To avoid the common frustrations and disputes associated with automated billing, our website does not support automatic recurring payments. Even when paying pursuant to a payment plan, users must manually authorize each individual transaction.
- Geographic Restrictions: Our payment processor may be unable to accept payments from financial institutions located outside of the United States.
- Privacy-Focused Payments: We accept Monero (XMR) for clients seeking enhanced privacy. Please contact our office directly for secure instructions on how to remit payment electronically via Monero.
